In order to use this application, including any third party software made available to you in conjunction with this application and/or the related service (collectively referred to below as the “F1 Timing Application) you must agree to be bound by these Terms and Conditions. If you cannot or do not wish to abide by these Terms and Conditions, please press “No” when asked whether you agree to these Terms and Conditions, and do not proceed with use of this product.
You acknowledge that use of the F1 Timing Application is subject to the applicable Licensed Application End User License Agreement governing your purchase of the F1 Timing Application, found at the URL, http://www.apple.com/legal/itunes/uk/terms.html#SALES (the “Licence Agreement”) and acknowledge that these Terms and Conditions are supplemental to and do not replace the Licence Agreement.
These Terms and Conditions will be available at all times on www.softpauer.com. They will be subject to change at any time by posting changes online. You are responsible for reviewing regularly information posted online to obtain timely notice of any such changes. By using this Application after any such changes you agree to comply with, and be bound by, the terms and conditions as changed.
Additional Terms
The F1 Timing Application is a Soft Pauer Limited (“Soft Pauer”) service. Subscription fees, if any, charged by Soft Pauer for use of the F1 Timing Application are stated in the order process for the application. However, depending on your mobile phone plan and your carrier or provider, you may incur data charges from your carrier or other provider for downloading and/or using the F1 Timing Application or other Soft Pauer mobile products and services. You acknowledge that your use of the F1 Timing Application and acceptance of these Terms and Conditions creates a binding agreement between you and Soft Pauer only and that Soft Pauer is solely responsible for the F1 Timing Application, the content therein any warranties to the extent such warranties have not been disclaimed, and any claims you or any third party may have relating to the F1 Timing Application or your use of the F1 Timing Application.
Certain content of the F1 Timing Application is used under licence from Formula One Administration Limited. You acknowledge and agree that Formula One Administration Limited (and any or all of its affiliates), are third party beneficiaries of these Terms and Conditions, and that, upon your acceptance them, Formula One Administration Limited (and any or all of its affiliates) will have the right (and will be deemed to have accepted the right) to enforce the same against you as a third party beneficiary thereof.
No Modifications
Unless you obtain Soft Pauer’s prior written consent, you agree not to reproduce, distribute, perform, display, modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble, or otherwise attempt to derive source code from the F1 Timing Application. The material and content provided on the F1 Timing Application is for your personal, non-commercial use only, save where expressly provided, and you agree not for yourself or through or by way of assistance from any third party to distribute copy extract or commercially exploit such material or content.
Furthermore, you may not use the F1 Timing Application in any manner that could damage, disable, overburden, or impair Soft Pauer’s services (e.g., you may not use the F1 Timing Application in an automated manner), nor may you use the F1 Timing Application in any manner that could interfere with any other party’s use and enjoyment of Soft Pauer’s services.
Intellectual Property Except as otherwise indicated, all materials on the F1 Timing Application, including, but not limited to live timing data, historical race data, photographs, other images, illustrations, text and written and other materials contained in the F1 Timing Application are protected by copyrights, database rights trademarks and/or other intellectual property rights owned by Soft Pauer, or used with permission of their owners. All rights are reserved.
The F1 FORMULA 1 logo, F1, FORMULA ONE, FORMULA 1, FIA FORMULA ONE WORLD CHAMPIONSHIP, GRAND PRIX and related logos are trademarks of Formula One Licensing BV. All results, timing data and certain other content are copyright Formula One Administration Limited. All rights reserved.
As between you and Soft Pauer you agree and acknowledge that Soft Pauer owns all rights, title, and interest in and to the F1 Timing Application, including without limitation all associated Intellectual Property Rights. "Intellectual Property Rights" means any and all rights existing from time to time under patent law, copyright law, trade secret law, trademark law, unfair competition law and related laws, and any and all together proprietary rights, and any and all applications, renewals, extensions, and restorations thereof, now or hereafter in force and effect worldwide. You agree to not remove, obscure or alter Soft Pauer’s or any third party’s copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the F1 Timing Application.
THE F1 TIMING APPLICATION IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOFT PAUER FURTHER DISCLAIMS ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE F1 TIMING APPLICATION AND SUCH THIRD PARTY SOFTWARE.
YOU UNDERSTAND AND AGREE THAT YOUR DOWNLOAD AND/OR USE OF THE F1 TIMING APPLICATION IS AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR MOBILE DEVICE AND/OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF THE F1 TIMING APPLICATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
